Assault Charges

Assault charges involve intentionally, recklessly or knowingly injuring another.  You can also be charged for threatening another and putting him or her in immediate fear of harm.  You may also be arrested for assault if you knowingly cause offensive contact with another even though it does not injure the other person.  Assault can be charged either as a misdemeanor or felony depending on its seriousness.  A misdemeanor simple assault charge is punishable with up to one year in the county jail.  A previous domestic violence conviction or a knowing assault on a security guard, emergency worker, or public servant in the performance of official duties can raise the assault charge to the 3rd degree felony with a 2 to 10 year sentence possible.

A still more serious charge is Aggravated Assault, a second degree felony with a prison sentence from 2 to 20 years.  This would be for causing serious bodily harm or using a weapon.
