Kidnapping Charges

Kidnapping is the intentional abducting of another person by transporting them or secreting them to prevent their liberation.  To be guilty of kidnapping an adult, there must be a use of force or intimidation.  In the case of a child under the age of 14, no force is necessary.  Even if the child acquiesces, it is still kidnapping unless a parent or guardian has given consent.  As for acquiescing children from 14 to 17, it is kidnapping to take the child outside the state or a 120 mile radius of the child's home without a parent's consent.

Penalties for Kidnapping

Kidnapping is a felony punishable from 2 to 10 years in the state prison and up to a $10,000 fine.  Where there is an intention to hold the person for ransom, use the person as a shield, or injure the person or abuse the person sexually, the charge is aggravated kidnapping with a potential sentence of 5 years to life.  If the person is released voluntarily in a safe place, the penalties are reduced.
